1. The service
FitBridge is a brand-side creator discovery and introduction service for the fitness and wellness space. We review creators and may make a warm introduction to a brand when there is alignment. We are not a party to the agreements between creators and brands unless expressly stated in a signed contract, and we do not guarantee that any introduction will result in a partnership or any particular outcome.
2. Eligibility
You must be at least 18 years old and able to form a binding contract to use our services. If you use the services on behalf of a company, you represent that you are authorized to bind that company to these Terms.
3. Fees and payment
- No upfront cost. Submitting an application or inquiry, and being considered, is free. We do not charge retainers or subscription fees to participate.
- Performance-based finder's fee. FitBridge earns a finder's fee only when a partnership we introduce becomes a paid engagement. The specific fee, terms, and timing are set out in the separate written agreement signed by the relevant party, which governs.
- Controlling document. If anything on this page conflicts with your signed agreement, the signed agreement controls.
4. Your submissions
When you submit an application, inquiry, or other information, you represent that it is accurate and that you have the right to share it. You grant FitBridge permission to use the information you provide to operate the service, including sharing relevant details with potential partners in order to facilitate introductions.
5. Acceptable use
You agree not to misuse the services. Among other things, you will not:
- Provide false, misleading, or fraudulent information, including fabricated audience or performance data.
- Attempt to circumvent FitBridge to avoid a finder's fee on a partnership we introduced.
- Use the services to violate any law or the rights of others.
- Interfere with or disrupt the integrity or performance of the site.
6. Intellectual property
The FitBridge name, logo, site content, and design are owned by FitBridge Media LLC and protected by applicable laws. You may not use our marks or content without our prior written permission. You retain rights to the content and information you submit, subject to the permissions you grant in these Terms.
7. Disclaimers
The services are provided "as is" and "as available" without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the services will be uninterrupted, error-free, or that any match will lead to a successful partnership.
8. Limitation of liability
To the maximum extent permitted by law, FitBridge and its members will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, arising out of or related to your use of the services. Our total liability for any claim relating to the services will not exceed the amount of fees you paid to FitBridge in the twelve months before the claim, if any.
9. Indemnification
You agree to indemnify and hold harmless FitBridge Media LLC and its members from any claims, damages, or expenses arising out of your use of the services, your submissions, or your breach of these Terms.
10. Governing law
These Terms are governed by the laws of the State of California, without regard to its conflict of laws rules. Any dispute will be resolved in the state or federal courts located in California, unless your signed agreement provides otherwise.
11. Changes to these Terms
We may update these Terms from time to time. Continued use of the services after changes take effect means you accept the revised Terms. We will update the "last updated" date above when we make changes.
